PRIVACY STATEMENT REGARDING ONLINE CONTENT FOR HONDA CUSTOMERS

Honda makes every effort to protect and respect your privacy. This privacy statement describes how Honda Motor Europe Logistics NV, with its registered office at Langerbruggestraat 104, 9000 Ghent, Belgium, with company registration number 0418.250.835, RPR/RPM Ghent, Ghent section (hereinafter referred to as ‘Honda’, ‘we/us/our’) processes your personal data when you visit or download Honda websites and apps that refer to this privacy statement (hereinafter referred to collectively as ‘Honda online content’), or when you contact Honda in connection with them. Your data protection rights, including the right to object to part of the processing by Honda, are also described in this statement. You can find more information on your rights and how to exercise them in the chapter ‘Your choices and rights’.

We may also provide you with additional information when we collect personal data, where we feel it would be helpful to provide relevant and timely information.

What personal data do we collect?

We process the following types of personal data:

  • Contact details such as your name, telephone number, e-mail address and other similar information.
  • Technical details about your visit to Honda’s online content such as your IP address and operating system, type of browser (for visits to our website), further information about the device you are using (e.g. serial number, unique identification number, MAC address) and technical and event-based data in connection with the use of your device (e.g. internet and Bluetooth link, connection data and session duration).
  • All other information you give to us, such as signatures, photographs, opinions, your location and any other information you share with us.

Why we collect, use and store this personal data

We collect, use and store your personal data for the purposes below.

  • When do so where necessary on the grounds of Honda’s legitimate interests, as defined below, as long as your data protection rights do not prevail over our interests.
  • to provide you with Honda’s online content and related services;
  • to manage resources for Honda’s online content;
  • to allow us to improve and optimise Honda’s online content and our products and services;
  • to respond to your request or query, for example by sending a quote, to locate the nearest Honda dealer or to set up an appointment with a Honda dealer;
  • to inform Honda dealers and branches of upcoming servicing, test drives or other appointments concerning you or your vehicle;
  • to contact you in connection with the latter two purposes (directly or through a Honda Group company, an authorised Honda dealer, a relevant partner or agent) by e-mail, text message or push notification;
  • to ask you to share your opinion or take part in surveys about our vehicles, products and services;
  • to understand what parts of Honda’s online content are popular and used most often, or what parts could do with an update or improvement; and
  • to answer questions and complaints from users; and
  • for internal registration.
  • When you have given your consent.
  • For example, to be able to send you direct marketing material, such as information about products and services that could be of interest to you, by post, telephone, e-mail and online. We always give you the option of unsubscribing to direct marketing.
  • Where necessary to comply with a legal obligation.
  • Where necessary to protect Honda’s legitimate and statutory rights, as long as your data protection rights do not prevail over our rights and interests.
  • To protect our legitimate corporate interests and statutory rights. This includes, but is not limited to, use in connection with compliance, objectives with regard to legislation, auditing, legal claims (including the publication of such information as part of legal proceedings or a court case) and other ethical and compliance reporting requirements.
  • Honda will also convert personal data into anonymous data and use it (usually based on aggregate statistical data) for research and analysis to improve Honda’s online content, analyse trends, and customise products. Aggregate personal information does not personally identify you or other users of Honda’s online content.

On what legal basis do we collect, use and store your personal data?

We will only process your personal data:

  • for the purposes stated in this privacy policy, and
  • if we have a legal basis to do so.

The legal bases we may invoke are:

  • Contract: a contract with you that we must perform, or to take steps prior to entering into a contract with you.
  • Consent: your freely given consent in which you are informed of what this consent means before you provide it.
  • Legitimate interest: a legitimate interest that we pursue as a company, including the optimisation of our service provision.
  • Legal obligation: a legal obligation we must comply with.

Where do we process your personal data?

In principle, we process your personal data within the European Economic Area (EEA).

We may also transmit your personal data to third parties that conduct processing on our behalf outside the EEA. Below, we describe how this processing occurs and what appropriate safeguards we take to protect your personal data in such cases.

Why we collect, use and store this personal data

(a) Data transfer within the Honda group of companies

We share your personal data with members of the Honda Group (for more information, see https://world.honda.com/profile/overview/).

 (b) Data transfer to authorised Honda dealers and repair shops

We share your personal data with authorised Honda dealers and repair shops in the EEA. You can consult a complete list of Honda dealers below:

(c) Data transfer to companies that provide services on the basis of a contract

Your personal data is shared with companies that provide services on the basis of a contract to the Honda group of companies such as the companies below:

  • IT hosting (current provider: IBM Belgium SRL/BV);
  • IT maintenance (current provider: Iotta);
  • events and database of leads (current provider: Iotta);
  • e-mail campaigns and communication (current provider: Iotta);
  • professional advisors and complaint handlers (current provider: xxx);
  • CRM provider and surveys (current providers: Eye2ID Visual Communication, MIT);

Data transfer outside the EEA (European Economic Area)

For the aforementioned purposes, we may send your personal data to organisations outside the EEA. In doing so, we may use standard contractual data protection clauses that have been approved by the European Commission. We may also transmit your data to organisations in the USA that are part of the EU-US Privacy Framework or that have corporate rules in place to protect your data, which are approved by the European data protection authorities. Third party apps

When you download a third-party app from the Honda online content, your personal data will be shared directly with that third-party app provider as a separate data controller. Honda is not liable for the processing of your personal data by such app providers. For this reason, we advise you to read and understand how your personal data will be used by app providers before you download their apps.

(d) Data transfer to other organisations

  • Data transfer to third parties if we have a duty to share your personal data to comply with a legal obligation or where we consider it necessary to protect the rights, property or safety of Honda, our customers or others.
  • Data transfer to public authorities and/or law enforcement officials if mandated by law or if required for the protection of our legitimate interests in accordance with the applicable laws.
  • Data transfer to potential or actual buyers in the event that Honda, or any member of the Honda Group, sells any of its business or assets which includes personal data.

How do we keep your personal data secure?

We have taken the appropriate technical and organisational measures to protect your personal data against unauthorised access, theft, accidental loss, manipulation or destruction. However, you acknowledge that the protection of your personal data is a best-efforts obligation. Access to your personal data by our staff or the staff of third parties occurs only where necessary and is subject to the appropriate obligations of confidentiality.

Your choices and rights

(a) Your general choices and rights

  • You have the right to ask Honda for a copy of your personal data; to correct, erase, or restrict processing of your personal data; and to obtain the personal data you provide in a structured, machine-readable format.
  • In some circumstances, you may object to the processing of your personal data (in particular when we do not have to process the data to comply with a contractual or other legal obligation).
  • Where we have asked for your consent, you may withdraw it at any time. If you ask to withdraw your consent to Honda processing your data, any processing that has already taken place at the time will remain unaffected.
  • These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to erase information which we are required to keep by law or because of compelling legitimate interests.

(b) Your rights and choices with regard to direct marketing

Honda will give you the opportunity to opt in (consent) to having your contact details used for direct marketing purposes when we ask you to provide your data. If you do not wish to receive direct marketing material from us, or to have your personal data used for profiling in connection with direct marketing, or to have your data shared with third parties for marketing purposes, you may at any time ask us not to do so by:

  • replying to a marketing e-mail with ‘unsubscribe’ in the subject line;
  • changing the privacy settings in the app (if applicable to the app);
  • contacting us at the address under ‘contact us’ or by writing to Honda Motor Europe Logistics, Langerbruggestraat 104, 9000 Ghent, Belgium

(c) Your right to make a complaint to a supervisory authority

You also have the right to lodge a complaint with a data protection authority. The supervisory authority may be located where you live, where you work, or where a breach of data protection obligations has taken place.

Data retention

We will retain your personal data only for as long as we need it for Honda's legitimate interests in accordance with applicable laws, or to perform a service at your request, or to meet a legal requirement. Personal data shall under no circumstances be kept for longer than five years after we first collected the data. At the end of the retention period, we will take the necessary steps to delete your personal data or store them in a form that no longer identifies you.

Fake e-mails in Honda’s name

Honda is aware of fake e-mails, also known as phishing. Such e-mails may contain announcements such as recruitment ads, job offers and announcements of competition prizes. These e-mails use Honda’s name to appear authentic and are purely intended to obtain customers’ personal information (e.g. credit card numbers or passwords). Honda has nothing to do with these e-mails and Honda does not use such methods for recruitment or to communicate with prize winners.

Unfortunately, these fake e-mails are a growing form of internet fraud. This practice either occurs by sending a fake e-mail to victims directly, or by directing them to a website that asks for personal data. Fake job ads are usually addressed to people abroad, with the fraudsters asking for money for a Belgian visa application. Honda will never ask for payment details in connection with recruitment or communications in this context. If you have any doubts as to the validity of a job offer, please contact Human Resources, Honda Motor Europe Logistics, Langerbruggestraat 104, 9000 Ghent, Belgium.

There have been recent e-mails about competition prizes claiming to come from Honda. Honda will never ask for payment details in connection with prize winners or communications in this context. Honda advises you to be very careful when you receive an e-mail in Honda’s name in which personal or financial information is requested, and if you have doubts as to its authenticity.

Links to third-party websites

From time to time, our website may include links to and from websites of our partner networks, advertisers and companies that form part of the Honda Group. Honda is not responsible for the content of websites with links to its website. When you visit a third-party website, it is your responsibility to read the privacy policy and legal terms and conditions that apply to that website.

Updates to this privacy statement

This privacy statement is subject to periodic updates. We will amend the date at the top of this privacy statement as we update it, and we encourage you to check the Honda online content for changes to this privacy statement. In some cases, we will also proactively advise you of certain data processing activities or significant changes to this privacy statement, as required by the applicable legislation
